South Sumatra Provincial Regulation on Forest and Land Fire Management 2016

The South Sumatra Provincial Government issued Regional Regulation No. 8 / 2016 dated 21 April 2016 on the Management of Forest and/or Land Fires. The birth of this regulation constitutes an effort to organize the prevention, management, handling, and monitoring of forest and land fires in South Sumatra. In short, the regulation contains bans on burning forest and/or land, local community contributions to protecting forest, and the responsibilities of license holders over their concession lands.

Previously, from January to February 2016, in collaboration with the South Sumatra Province Forestry Office, BIOCLIME supported regional governments in preparing legal instruments as the means for authorities to control forest and land fires. Through forestry offices, BIOCLIME facilitated the preparation of an Academic Draft of a Provincial Regulation on Management of Forest and Land Fires in South Sumatra province.

The draft regulation was officially submitted at a joint meeting of DPRD regional representatives on 9 February 2016, and was passed as a regional regulation on 21 April 2016. Several of its articles provide penalties of a maximum of 6 (six) months imprisonment or a maximum fine of IDR 50,000,000 (fifty million rupiah) for their violation. Whereas any individual or legal entity that either intentionally, or through negligence, causes forest and/or land fires is threatened with criminal proceedings in accordance with the law.
